Full Event Terms and Conditions:

NYT Cookies 24 (the “Event”) is owned and organized by The New York Times Company (the “Organizer”). If you register for the Event as a representative of a company or other organization, you confirm that you have authority to agree to these Terms and Conditions on behalf of the company or other organization. You shall also ensure participant(s) from the company or other organization attending the Event are made aware of and shall adhere to these Terms and Conditions.

We may revise and update these Terms and Conditions from time to time in our sole discretion. All changes are effective immediately when we post them. By attending the Event after the effective date of any modifications to these Terms and Conditions, you agree to be bound by the modified terms. You are expected to check this page from time to time so you are aware of any changes, as they are binding on you.

Safety and Security:

For the safety of visitors, the Organizer reserves the right to refuse admission to any attendee and may on occasion conduct security searches of persons or belongings to ensure the safety of visitors to the Event. The Organizer shall also be entitled to refuse access to or remove anyone from the Event who is violating any law or any rule of the Event or any Event venue, is under the influence of drugs or alcohol, or who, in the reasonable opinion of the Organizer, is conducting themselves in a manner inappropriate to their continued attendance or who is in breach of any other policies (e.g., policies relating to mobile phone or camera use) put in place by the Organizer, including, but not limited to, these Terms and Conditions. If Organizer denies you entry or requires you to leave, you will not receive a refund.

Recordings:

Unless otherwise agreed, any material filmed or recorded by you at the Event may only be used for the personal, noncommercial, nonprofit-making enjoyment of the registration holder. The Event may be recorded, broadcast, exhibited and publicly performed by the Organizer and sponsors, and you may be photographed or filmed as part of the audience. By attending the Event, you are granting your permission on behalf of yourself to be photographed or recorded for commercial purposes and agree to the following: being filmed, videotaped, photographed, broadcast, exhibited and publicly performed by any media and means; full use of your name, likeness, voice and words by the Organizer and/or its sponsors, affiliates and partners, without compensation; specifically waiving all rights of privacy in connection with the videotaping, filming, broadcast, exhibition and public performance; and release the Organizer and sponsors from liability for loss, damage or compensation for the use of your name, likeness, voice and words; compliance with all rules and regulations of the Event.

Mobile Services, Electronic Communications and Contact Information:

You may be required to provide a phone number to participate in programs or promotions (“Mobile Services”). By providing your mobile number as a contact point in connection with such Mobile Services, you agree that we may communicate with you by SMS, MMS, text message or other electronic means to your mobile device and that certain information about your participation in such Mobile Services may be communicated to us. You are not required to provide your mobile number or consent to receive marketing messages to participate in an Event. Mobile Services may not be accessible or may have limited utility over some carriers. We cannot guarantee that all carriers will support Mobile Services. You understand that your carrier's messaging, data and other rates and fees will apply to Mobile Services and other communications. You should check with your carrier to find out if Mobile Services are available to you, what plans are available, and how much they cost. Text messages may be provided using automated technology. Text message frequency varies and message and data rates may apply. If you receive an SMS, MMS, or text message to your mobile from us, you may also reply “HELP” for help or “STOP” to cancel. You consent to receive communications from us electronically via SMS, MMS, text method, E-mail, or other electronic means. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirements that such communications be in writing. All notices by you to us must be in writing and addressed to: legal@nytimes.com or The New York Times Company, Attn: Legal Department, 620 Eighth Avenue, New York, NY 10018.

Additional Policies:

Attendees agree to adhere to any policies relating to mobile phone and camera usage put in place by the Organizer and/or Event venue(s).

Assumption of Risk; Limits of Liability:

THE ATTENDEE VOLUNTARILY ASSUMES ALL RISK AND DANGER INCIDENTAL TO THE EVENT, WHETHER OCCURRING PRIOR TO, DURING OR AFTER THE EVENT. THE ATTENDEEVOLUNTARILY AGREES THAT THE FACILITY, SPONSORS, PARTICIPANTS, THE ORGANIZER AND ALL OF THEIR RESPECTIVE AGENTS, OFFICERS, DIRECTORS, OWNERS, AFFILIATES, EMPLOYEES AND CONSULTANTS ARE EXPRESSLY RELEASED BY THE ATTENDEE FROM ANY CLAIMS ARISING FROM SUCH CAUSES. ATTENDEES’ STATUTORY RIGHTS AS CONSUMERS IN CONNECTION WITH THE TICKETS THROUGH THE EVENT WEBSITE ARE NOT AFFECTED BY THESE TERMS AND CONDITIONS. IN NO EVENT SHALL ORGANIZER BE LIABLE TO YOU OR ANY THIRD PARTY FOR CONSEQUENTIAL, INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR ENHANCED DAMAGES, ARISING OUT OF, OR RELATING TO, AND/OR IN CONNECTION WITH ANY BREACH OF THESE TERMS, REGARDLESS OF (A) WHETHER SUCH DAMAGES WERE FORESEEABLE, (B) WHETHER OR NOT ORGANIZER WAS ADVISED OF THE POSSIBILITY OF SUCH DAMAGES AND (C) THE LEGAL OR EQUITABLE THEORY (CONTRACT, TORT OR OTHERWISE) UPON WHICH THE CLAIM IS BASED.

ORGANIZER’S SOLE AND ENTIRE MAXIMUM LIABILITY, FOR ANY REASON, AND YOUR SOLE AND EXCLUSIVE REMEDY FOR ANY CAUSE WHATSOEVER, SHALL NOT EXCEED USD $100. THE LIMITATIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.

Governing Law:

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New York without regard to its conflict of laws principles that require another state’s law to apply. Any claim arising under this agreement shall be prosecuted in a federal or state court of competent jurisdiction located within New York, New York. To the extent permitted in law, any cause of action an attendee may have with respect to their tickets must be commenced within one (1) year after the claim or cause of action arises.

Waiver; Severability:

If any of these Terms and Conditions should be determined to be illegal, invalid or otherwise unenforceable by reason of the law of any state or country in which these Terms and Conditions are intended to be effective, then to the extent and within the jurisdiction in which that term or condition is illegal, invalid or unenforceable, it shall be severed and deleted from that term and the remaining Terms and Conditions shall survive and continue to be binding and enforceable.

Privacy:

For information on how Organizer collects, uses and shares any personal information, attendees are invited to review our Privacy Policy. If attendees reside outside of the European Economic Area, their acceptance of these Terms and Conditions constitutes their consent to the processing activities described in our Privacy Policy under the laws of your jurisdiction.
